The real legal question behind this is whether or not the state's actions violated the spirit or letter of any antitrust laws. In my opinion, the state was definitely attempting to stifle competition in this instance.
There are allegations that the city counsil is involved in a quid-pro-quo with the bars that if they gave them their price fixing the council would not approve any liquor licences for new bars. Which would be even more violations of the antitrust laws. All because Madison was ranked #1 party school by Playboy.
